Had an Accident in Someone’s Home?

With the best will in the world accidents can happen but what if you have an accident at someone’s house where you are a legitimate visitor, through no fault of your own.

Well some accidents are not in any sense actionable. They may for example be your own fault. But what if you have an accident because of a slippery surface or a chair collapsing or something falling on your head for example which is not your fault? Is there anything you can do about this?

Well if injuries are minor and you get over it quickly you would not want to but what if injuries are more long standing, prevent you from working, carrying out your normal duties, looking after your children, driving etc. and put you to significant inconvenience and expense? Is there anything you can do in that situation?

The answer is yes. Almost everyone has home insurance so insurers will deal with, subject to liability, claims against the householder for accidents that may have occurred on the premises and caused loss and injury. If as a householder you receive such a claim pass it straight to your insurers and they will deal with it for you without expense to yourself.

If you are the victim of the accident then discuss this with the householder and ask for their insurance details and either write direct to them to be passed to their insurers or write to their insurers direct but ask them to report it to their insurers. Usually these claims can be dealt with in a constructive and positive manner as everyone wishes the accident had not occurred and if circumstances can be improved by financial compensation then that is in all parties’ interests.

You needn’t fall out with your friend or neighbour about a claim of this sort as long as everyone deals with it in a constructive and positive way.
